Summary of Role
This position provides legal advice, counsel, support, and representation for the Authority concerning all aspects of workers’ compensation matters and employee benefits.
Key Responsibilities
- Provides legal analysis, counsel, and support for workers’ compensation matters and claims management.
- Represents the Authority in all stages of workers’ compensation matters before the Department of Industrial Accidents and in court.
- Collaborates with Human Resources, Risk Management, safety personnel, and third-party administrators.
- Assesses liability, recommends and negotiates settlements, and participates in mediations.
- Supports HR regarding Medicare, Medicaid, and third-party liens.
- Represents the MWRA before the MWRA Retirement Board and addresses issues under G.L. c. 32.
- Ensures compliance with statutes including FMLA, ADA, and Paid Family and Medical Leave Act.
- Conducts legal research, drafts discovery, and prepares legal memoranda, motions, and briefs.
- Drafts and amends internal policies, rules, and standard operating procedures.
- Conducts trainings for staff and contractors.
Required Qualifications
- Juris Doctorate from an accredited law school.
- Minimum of 7 years of legal experience involving workers’ compensation and employment laws.
- At least 5 years of experience representing clients before the Department of Industrial Accidents.
- Knowledge and understanding of state and federal employee leave and benefits laws.
- Admittance in good standing to the bar to practice law in Massachusetts state and federal courts.
- Valid Class D Motor Vehicle Operator’s license.
Knowledge and Abilities
- Strong analytical, research, organizational, and communication skills.
- Ability to work independently and as a member of a dynamic team.
- Experience interpreting and advising on laws, court decisions, and regulations.
- Experience conducting investigations is preferred.
- Highly motivated, detail-oriented self-starter.
Physical Demands and Work Environment
The employee regularly works in a moderately quiet office environment. The role requires regular sitting, talking, and hearing, as well as the use of office equipment. The employee is frequently required to stand and walk, and the job may involve lifting objects of nominal weight. Specific vision abilities include close vision and the ability to adjust focus.
Supervision
Works under the general supervision of the General Counsel or Associate General Counsel (Labor and Employment). This position exercises supervision of a legal assistant and/or support staff.
